Across the country, members report that UPS is eliminating Article 22.3 jobs by failing to fill vacant positions and even laying off Article 22.3 Teamsters. What's happening with 22.3 jobs in your building/local?

Portland 5550 building local 162 22.3 job talks of displacement into the main sort. fortunately a number of people have a large amount of vacation scheduled for the amount of work we see weekly. The ODC/unload combo jobs have had problems with supervisors using the internet to key enter/audit paperless shipments from the Suspense Report. This means the volume is key entered from the system and audited before we actually see the physical package. This takes volume/work away. I don't understand why our supervisors seem to not care about taking our work away. Where’s the integrity?

Baltimore 355 Jobs are not being filled at all they say they are revaluating the jobs I asked for a list of the job and sent a letter to local and to IBT to ask for all 22.3 jobs to counted and a list sent to local have not heard a word from local or international planning a meeting with local on sun any suggestions that may help please feel free to email me

West Sacramento local 150 22.3 jobs are not being filled when vacated. We are 50 plus jobs short and the number keeps climbing. Grievences have been filed to make UPS honor the contract and maintained 20,000 jobs nationwide. Corporate UPS and the international teamsters have cut a deal to not fill vacated article 22.3 jobs. My local is of no help on this issue. My local feels I'm a threat to whatever deal they have with UPS. My grievence to fill the vacated positions deadlocked at the first level panel. Bottom line is UPS is collecting every vacant position and shipping them to the central states. And the union wants us gone because they can collect union dues and initiation fees from two partime employees instead of one. This is all about business for the IBT. Their suppose to fight for fulltime jobs not let them disappear.

Local 150 Rocklin, CA facility will be laying off (7) 22.3 positions as of Jan 30, 2009 and another (2) vacant 22.3 positions will not be rebid. Management has stated that these lay-offs are due to the slow down in the economy and the opening if the new Rancho Cordova Building where about 1/3 of the routes will be moving too. Management will not allow any 22.3's to follow their work either. Two options were afforded to us. Go back driving or work a split shift (pre-load 4-8am and local sort 6-10pm). Most 22.3's will be choosing the split shift. Our hourly pay rate also gets changed to our part-time building seniority rate as well.

Hey Bigbrother, Layoffs for article 22.3's goes by building senority they would have to layoff part-time employees before they lay you off. I'm a article 22.3 shop steward in the West sacramento building. No article 22.3's will be at the new rancho hub so following the work will be out of the question. Are you being reclassified as a part time employee? What is Perry Hogan and the local saying about the layoffs?

There have been no 22.3 layoffs in our building (Willow Grove, PA). So far, just the disappearance of vacated jobs and no new postings since '07.
I have requested more info from the BA (Local 384) accounting for the jobs that have been moved/not created, but it's like pulling teeth. Will resort to further measures soon.

Local 251 Providence RI: Low seniority feeder drivers (approx. 15) were bumped out of feeders, re-bid their jobs per layoff procedure. A few 22.3's were bumped out of their bid jobs (including myself), re-classified as part timers (but still guaranteed 8 hours a day, 40 a week), and work similar hours. Some vacated 22.3 jobs not previously filled were bumped into by these laid off drivers. Some drivers bid into package car. We anticipate low seniority package car being laid off to the inside, although stop counts aren't dropping (overall volume is lower). There was a line about progression freezing during lay off, but that was retracted (as it was a blatant lie). Top rate full timers bumped to unassigned were taking pay cuts to their part time rate determined by company start date. Word was that the company wanted to eliminate 22.3 jobs here, nothing official though. Our Local BA stated that a grievance was filed to protect 22.3's from being moved around, and that it was going to national panel. This proved to be a lie. We're bracing for the outcome of any deals with the company and Local over our jobs. There have been minimal part timers laid off, as the company likes to shuffle staffing, giving shifts off to those who want time off.

In the contract in the National Master, pg.124, Article 38 Change of Operations, section 1 (c)2, states: "Whenever a center or hub is partially closed and the work of package drivers and all other regular employees, part-time and full-time, excluding feeder drivers, is transferred to or absorbed by another center, the affected employees may either follow their work and have their seniority dovetailed in the new center or be allowed to exercise their seniority in their present center and displace the least senior employee in their respective classifications. If any of the employees whose work is transferred elects not to follow his/her work, then he or she shall have the same rights as the remaining employees on the seniority list from which the work was transferred to bid the work being transferred. Those employees who follow the work shall have their seniority dovetailed in the new center." So contractually you should be able to follow your work, but I can see that with a split-shift it's not possible to maintain your 22.3 job as a whole. And these aren't "layoffs", these are Article 22.3 job eliminations. Layoff would mean you would be able to go back to your old job when business picks up. Also, the Letter of Understanding for Article 22.3 employees on pg.101 of the Northern California Supplemental agreement states in #3 that "if an Article 22.3 job is changed by 50% or more, the employee shall have the right to retain the job or exercise their seniority to bump into a different Article 22.3 job. Fifty percent (50%) as used in this article is defined as either the entire first shift job or entire second shift job being changed. The Union will be notified of any proposed changes to an Article 22.3 position at least 30 days prior to implementation of said changes." So if you have enough seniority, you should look into getting one of those 2 vacant 22.3 positions since 50% or more of your 22.3 is changed. I would definately ask the Local 150 about this. Those guys won't do anything they aren't asked to do. Make sure everyone you know has a copy of the contract so you can keep pressure on the Local Union.

There should not be ANY eliminations of Article 22.3 jobs if UPS or the Union can't prove that they have 20,000 Article 22.3 jobs nationwide.
All Article 22.3 employees who have been moved back to part-time status should file a class action lawsuit asking UPS and the Union to show proof where these 20,000 jobs are. If they can't prove it, they have no right to eliminate and take away these full time jobs.
I think a class action is the ONLY way we will ever see that list.

We need to tell them we are not getting representation from our Union even though we are paying dues. UPS and the IBT are not showing proof that they have created and maintained 20,000 Article 22.3 jobs nationally. They are just eliminating 22.3 jobs without a valid explanation. This would make a great national news story because it is going on in hubs and centers across the USA. I'm sure if we create exposure like this UPS and IBT will have to answer the ultimate question: Where are these 20,000 full-time jobs and why won't you provide the report detailing and identifying the full-time jobs which need to be maintained?

Basically it's a breach of contract that UPS has not provided the IBT the report detailing and identifying the full-time jobs that need to be maintained. If UPS has indeed provided the report to the IBT, and the IBT is not letting the local Union access the report, then something is very wrong here! Were talking under the table dealings. Like I said before, it seems we will have to file a nationwide class action lawsuit for breach of contract. I really think it's the only way to force them to provide the report showing all 20,000 Article 22.3 jobs. But we all know there never were that many anyway.

I've just sent an email to local news station KCRA Channel 3 about our national problem with the Union and UPS eliminating Article 22.3 jobs.
Hopefully they will want to do a story on this national problem and we can show UPS, and the Union, that the spotlight is on them.
I'll be notifying Channel 10 and 13 also. Maybe some radio stations like KFBK Newstalk 1530 will take notice in our story as well. Should I contact Howard Stern too? Ha, ha! (Actually I just did!)
I also sent an email to The Sacramento Bee.
I'm not going to take this situation lightly anymore. No Union representation and no proof where these 20,000 jobs are? After how many YEARS? Enough is enough!
If anyone here is willing to talk with reporters let me know. If not, that's ok too.

I will talk to reporters, I have been pushing to stop article elimination since last april. My grievence hasn't even been to a second level panel yet. The union is not on our side so if I upset them by trying to do what they should be doing to protect us, then oh well. All you hear is more article eliminations and nothing of what the IBT is doing to help. I found out about the Rocklin building eliminating article 22.3 jobs from this message board and not from local 150. I'm a steward for them at the west sacramento building. Why all the secrets? We have definetley been misrepresented by our local and the IBT. Whatever action needs to be taken against them I'm in. Because elimination means elimination regardless if you have a family to support.
